Welcome to PIVRIO. These Terms of Service (“Terms”) govern your access to and use of the PIVRIO website at pivrio.com (the “Site”) and any products or services purchased through the Site. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site or purchase from us.

PIVRIO (“we,” “us,” “our”) is a premium skincare brand specializing in barrier-repair products. We operate a Bitcoin-only payment model — we do not accept fiat currency (USD, EUR, etc.) or mainstream payment processors such as Stripe, PayPal, Visa, or Mastercard.

1. General Conditions

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information — which we never collect) may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Bitcoin transaction data is transmitted over the Bitcoin blockchain and is pseudonymous by design.

2. Account Terms

To place an order, you may be required to create an account on the Site. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Provide accurate, current, and complete account information;
  • Update your information promptly if it changes;
  • Notify us immediately of any unauthorized use of your account;
  • Not use a false identity or misrepresent any affiliation with another person or entity.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or disruptive behavior.

3. Products & Availability

All products listed on the Site are subject to availability. We make every effort to display accurate descriptions, images, and pricing, but we do not warrant that product descriptions or other content are error-free, complete, or current. We reserve the right to discontinue any product at any time without notice. Prices are listed in United States Dollars (USD) as a reference; actual payment is settled exclusively in Bitcoin at the exchange rate displayed at checkout.

4. Payment Terms — Bitcoin Only

4.1 Cryptocurrency-Only Payment. PIVRIO accepts payment exclusively in Bitcoin (BTC) via BTCPay Server, a self-hosted, open-source payment processor. We do not accept credit cards, debit cards, PayPal, Stripe, bank transfers, or any other fiat-based payment methods. No fiat currency is processed or stored by PIVRIO at any point.

4.2 No Chargebacks. Bitcoin transactions are irreversible once confirmed on the blockchain. By completing a purchase, you acknowledge that Bitcoin payments are final and cannot be charged back, reversed, or disputed through any financial institution or payment processor. All sales are final subject to our Return & Refund Policy (Section 7).

4.3 Pricing & Exchange Rates. Prices displayed on the Site are denominated in USD for reference. At checkout, you will be presented with a BTC invoice denominated in satoshis or BTC at the prevailing exchange rate. This rate may fluctuate before the invoice is paid. Each invoice is valid for a limited time window (typically 15–60 minutes) as displayed at checkout. If the invoice expires, you must initiate a new order.

4.4 Order Confirmation. Your order is confirmed only when the Bitcoin payment is detected by BTCPay Server and we issue a confirmation via email. We reserve the right to cancel any order — even after payment — if we suspect fraud, violation of these Terms, or if the product is unavailable.

4.5 Refunds. Refunds, when issued under our Return & Refund Policy, will be returned in Bitcoin at the BTC/USD exchange rate prevailing at the time of the refund. PIVRIO is not responsible for any decrease in Bitcoin value between the original purchase and the refund date.

5. Pricing & Promotions

All prices are subject to change without notice. We reserve the right to modify or discontinue any promotion, discount, or coupon code at any time. Promotions cannot be combined unless explicitly stated. We are not liable for typographical errors in pricing or promotional materials. In the event of a pricing error, we reserve the right to cancel the affected order and issue a full refund.

6. Shipping Policy

6.1 Processing Time. Orders are processed within 1–3 business days after payment confirmation. During high-volume periods or promotional launches, processing may take up to 5 business days.

6.2 Shipping Methods & Carriers. We ship via reputable carriers (USPS, UPS, FedEx, or DHL depending on destination). Shipping options, costs, and estimated delivery times are displayed at checkout.

6.3 Domestic & International Shipping. We ship to addresses within the United States and select international destinations. International orders may be subject to customs duties, taxes, and import fees, which are the sole responsibility of the customer. Delivery times for international orders are estimates and not guaranteed.

6.4 Tracking. A tracking number will be provided via email once your order has shipped. We are not responsible for delays caused by the carrier or customs.

6.5 Lost or Damaged Shipments. If your package is lost or damaged in transit, please contact us within 7 days of the expected delivery date. We will work with the carrier to resolve the issue. We are not liable for packages marked as delivered by the carrier.

6.6 Incorrect Address. PIVRIO is not responsible for orders shipped to an incorrect address provided by the customer. If an order is returned to us due to an incorrect address, we will contact you to arrange re-shipment at your cost.

7. Return & Refund Policy

7.1 30-Day Return Window. We accept returns of unopened, unused products in their original packaging within 30 days of the delivery date. To initiate a return, please contact us at support@pivrio.com with your order number and reason for return.

7.2 Condition Requirements. Returned items must be unopened, unused, and in their original packaging. We reserve the right to reject returns that do not meet these conditions.

7.3 Return Shipping. The customer is responsible for return shipping costs unless the return is due to a defect or error on our part. We recommend using a trackable shipping method. PIVRIO is not responsible for items lost during return shipping.

7.4 Refund Processing. Once we receive and inspect the returned item, we will process your refund within 5–10 business days. Refunds are issued in Bitcoin to the original payment address or a BTC address you provide. The refund amount will be calculated at the BTC/USD exchange rate at the time of refund processing.

7.5 Exceptions. Final sale items, samples, and gift cards are non-returnable and non-refundable.

7.6 Damaged or Defective Products. If you receive a damaged or defective product, please contact us within 48 hours of delivery with photos of the damage. We will arrange a replacement or full refund, including return shipping costs.

8. Privacy & Data Protection

Your privacy matters to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Because we use BTCPay Server for payment processing, we never receive, store, or process your credit card or banking information. Bitcoin transaction data is handled on the blockchain and is pseudonymous. We collect only the minimum personal information necessary to fulfill your order (name, shipping address, email address) and to communicate with you about your purchase. We do not sell your personal information to third parties.

9. Intellectual Property

9.1 Ownership. All content on the Site — including but not limited to text, graphics, logos, images, product formulations, packaging designs, taglines, and software — is the property of PIVRIO or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

9.2 Trademarks. “PIVRIO,” the PIVRIO logo, and all related names, logos, product and service names, designs, and slogans are trademarks of PIVRIO. You may not use these marks without our prior written permission.

9.3 Limited License. You are granted a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes and to purchase products for personal use. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content from the Site without our express written consent.

9.4 User Content. If you submit reviews, testimonials, or other content to the Site, you grant PIVRIO a non-exclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, publish, and display such content in any media. You represent that your content does not infringe any third-party rights.

10. Third-Party Links & Services

The Site may contain links to third-party websites or services (including BTCPay Server) that are not owned or controlled by PIVRIO. We are not responsible for the content, privacy practices, or terms of any third-party sites. Your interaction with third-party services is solely between you and the third party. We encourage you to review their terms and policies before engaging with them.

11. Limitation of Liability

11.1 No Liability for Certain Damages. To the fullest extent permitted by applicable law, PIVRIO, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, the products purchased, or these Terms — including but not limited to loss of profits, data, use, goodwill, or other intangible losses, even if we have been advised of the possibility of such damages.

11.2 Bitcoin Volatility. PIVRIO is not liable for any loss resulting from Bitcoin price volatility, including but not limited to changes in the value of Bitcoin between the time of order placement, payment confirmation, and any refund processing. You acknowledge that cryptocurrency markets are volatile and assume all risk associated with fluctuations in Bitcoin value.

11.3 Maximum Liability. In no event shall PIVRIO’s total liability to you for all claims arising from or relating to these Terms, the Site, or any products purchased exceed the total amount paid by you to PIVRIO for the specific product giving rise to the claim.

11.4 Force Majeure. We shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, pandemic, government action, blockchain network congestion, power outages, or internet disruptions.

12. Indemnification

You agree to indemnify, defend, and hold harmless PIVRIO, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property or privacy rights; or (d) any content you submit to the Site.

13. Prohibited Uses

You agree not to use the Site for any unlawful purpose or in violation of these Terms. Prohibited activities include but are not limited to:

  • Attempting to interfere with the proper functioning of the Site;
  • Circumventing any security measures or payment mechanisms;
  • Using bots, scrapers, or automated tools without our permission;
  • Misrepresenting your identity or affiliation;
  • Engaging in any activity that could damage, disable, or impair the Site or our systems.

14. Disclaimer of Warranties

The Site and all products sold through it are provided on an “as is” and “as available” basis without any warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. We do not warrant that the Site will be uninterrupted, secure, or error-free. We make no representations regarding the accuracy, reliability, or completeness of any content on the Site. Skincare products affect individuals differently; results are not guaranteed, and PIVRIO does not provide medical or dermatological advice.

15. Governing Law & Dispute Resolution

15.1 Governing Law. These Terms and any disputes arising from them shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws principles.

15.2 Informal Resolution. Before initiating any formal proceeding, you agree to first contact us at support@pivrio.com and attempt to resolve the dispute informally for a period of 30 days.

15.3 Binding Arbitration. If the dispute cannot be resolved informally, it shall be resolved through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration shall be conducted in Wilmington, Delaware. You agree that any arbitration shall be conducted on an individual basis — class arbitration, class actions, and representative actions are expressly waived.

15.4 Small Claims. Either party may bring individual claims in small claims court in Delaware if the claims qualify and remain in that court.

16. Changes to Terms

We reserve the right to update or modify these Terms at any time without prior notice. Changes will be effective immediately upon posting to the Site. Your continued use of the Site after any changes constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically. The “Last updated” date at the top of this page indicates when these Terms were last revised.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire and exclusive agreement between you and PIVRIO regarding your use of the Site and purchase of products, superseding any prior agreements or understandings, whether written or oral.
